GA - Deputy Accused Of Child Molestation

HALL COUNTY - A veteran of the Hall County Sheriff's Office is off the job and facing child molestation charges.

Michael Nix, 42, is accused of aggravated child molestation.

Officers said he molested a 3-year-old girl his wife was babysitting.

Late Thursday afternoon, Nix was arrested and charged with one count of aggravated child molestation by investigators with the Georgia Bureau of Investigation.

As a result of the investigation and arrest, Nix has been terminated from the Hall County Sheriff's Office.
- So much for innocent until proven guilty!

Nix had been employed by the Hall County Sheriff's Office for 20 years and had served as an investigator in the internal affairs unit.

He is currently being held at the Hall County Jail without bond.

Officials with the GBI said they continue to investigate.

I never believed Michael Jackson did what people say he did, and also neither did a massive jury.  He was acquitted on ALL charged, so therefore, he is not guilty.  I don't care what people "think" he may have done, you are innocent until proven guilty, and by this idiot coming out on national TV to spew more hatred, when a family is in morning, is just sick, IMO.  They have no respect for the constitution, and continue to blatently violate many aspects of the document which has held this country together for many, many years.  Now the country is falling a part, and they wonder why?  As in the days of Lot, so shall it be in the end of time.  The US is falling, just like Rome did in Lot's days.  Although, I do not think we need any resolution to honor ANYBODY, that is just absurd, IMO.  They legislature is there to make and pass constitutional, fair laws, not idiotic laws to honor someone.  Get a grip people, get back to the constitution.



House Speaker Nancy Pelosi shut the door Thursday to a resolution honoring Michael Jackson because debate on the symbolic measure could raise "contrary views" about the pop star's life.

Lawmakers are free to use House speeches "to express their sympathy or their praise any time that they wish," said Pelosi, D-Calif. "I don't think it's necessary for us to have a resolution."

A resolution sponsored by Rep. Sheila Jackson Lee (Contact), D-Texas, cites some of the singer's charitable acts and proclaims him an American legend, musical icon and world humanitarian.

Even before Pelosi's comments, some Democrats said privately they did not support the resolution and a divisive debate would hurt House efforts to muster the votes for priorities such as health care and climate change.

Rep. Peter King, R-N.Y., who posted a video on YouTube calling Michael Jackson a "pervert" and a "pedophile," has pledged to do all he could to block the resolution.
- This man is a hateful idiot.  You are innocent until proven guilty and Michael Jackson was NEVER proved to be guilty, so he's letting his PERSONAL feelings get in the way.  This kind of person should NOT be running this country or deciding what should or should not be done.  Did Mr. King come out like this when another republican (Mark Foley) was charged?  He was acquitted as well.

Michael Jackson was acquitted in 2005 of charges that he molested a 13-year-old boy. Those allegations, and his admission that children slept in his bed at his home but nothing sexual occurred, have led some members of Congress to put distance between themselves and any formal honor for the entertainer.

"A resolution, I think, would open up to contrary views to — that are not necessary at this time to be expressed in association with a resolution whose purpose is quite different," Pelosi said at a Capitol Hill news conference where she discussed various legislative matters.

Unbowed, Jackson Lee said she will seek support from colleagues who thanked her when she introduced the measure June 26, one day after Michael Jackson died. She said honorary resolutions don't often "pass the next day."

"On this floor we elevate people and doing that we have to work to tell your story," she said after a House vote. But she would need support from Democratic leadership for the resolution to advance to the full House from the committee where it is now.
- Many know Michael Jackson was a legend and icon, and always will be, but then there are others who will always think otherwise.  So let it be that, we do not need some resolution for this.  Come on!

When members of the Congressional Black Caucus held a moment of silence in the House after Jackson died June 25, some lawmakers walked out of the chamber.

Jackson Lee has pledged that the resolution, now before the House Foreign Affairs Committee where she is a member, would come to the full House for debate. Such honorary measures normally move quickly from committee to the full House and pass on a voice vote.

But Jackson Lee's resolution was in trouble early. It drew only one co-sponsor, Rep. Diane Watson (Contact), D-Calif., and was not endorsed by other black caucus members.

From the stage at Jackson's memorial Tuesday at the Staples Center in Los Angeles, Jackson Lee hoisted a framed copy of the resolution.

NY - Sex Offender Assessment Tool Held Inadmissible

A recent decision out of New York holds the Static-99, a common actuarial measure of sex offender recidivism, as inadmissible under Frye. In State v. Rosado, 2009 NY Slip Op 29290 , Judge Riviezzo holds:

In the immediate case, respondent's STATIC-99 score of "4" is considered to be a medium-high risk of reoffending. Under the "new" norms, assuming future admission under Frye, that risk percentage varies from 8.2 % to 27.3% over 10 years. Interestingly, respondent's score of "4" - clearly not low, however not squarely high - provides the perfect example of the pitfalls of admitting the STATIC-99 at a jury trial. The testimony could arguably benefit respondent if, for example, the jury believed that the risk was in fact closer to 8%, but could be greatly prejudicial to respondent if the jury accepted testimony that the risk was in fact closer to 27%. However as discussed above the score of "4" has at best marginal relevance to the issue of whether respondent has a mental abnormality in the first instance, since the score only means that respondent shares certain characteristics of a group found to reoffend at a certain rate without telling the jury anything about respondent's volitional capacity. Given the tenuous connection between a STATIC-99 score and volitional capacity, a jury could easily be confused by the evidence and give it undue significance in either direction. In this case, a jury, believing this score to be low, might wrongfully conclude that respondent has no mental abnormality when in fact one might exist, even if ultimately confinement might not be required due to his "lower" risk of reoffending.

There's lots of interesting issues discussed in this case, including NY's unique bifurcated commitment statute and whether recidivism tools such as the Static-99 can be used to establish a mental abnormality. Interestingly, it was the state which argued for exclusion of the evidence.

But the case is noteworthy for its extended discussion of the Static-99 tool itself. To be fair, the disparate range of recidivism rates that the court seems concerned about center on the fact that recidivism rates generally go up over time. The instrument itself provides different recidivism rates depending on the length of follow-up.

MEMPHIS - Some Olive Branch residents are outraged about flyers, littering their yards.

The flyers warned of a convicted sex offender, living in the neighborhood, but they were distributed by a group with a racist, violent history toward Jews and blacks.

The flier was found scattered about the Allendale Cove neighborhood last week.

It was in a plastic bag with a rock inside.

The flyer notifies homeowners that a convicted sex offender lives on the next street, but take a closer look and you see the flyer was distributed by the Ku Klux Klan.

The KKK says it's a public service but an organization that tracks hate groups says that's simply ridiculous.

Buddy Robinson President of the Allendale Cover Homeowners Association says, "I was really shocked because you haven't heard anything from this group in years, at least I haven't and now all of a sudden they're in my community. we don't need any organization coming in and causing trouble with any of the homeowners in this area."

Robinson says the flyer's prompted dozens of complaints from residents.

He says, "It brought up an area of concern not just because we have a sex offender living in our area but it being from the KKK, like it is. We don't want anybody to think we're apart of that kind of group."

Not only do the Allendale Cove residents we spoke with, not want to be associated with the KKK, but they think the flyers serve a purpose other than to notify them of a sex offender.

At the bottom is a solicitation for donations.

Robinson says, "I believe they're heavy into recruiting because things might be getting slim for them these days with people changing their opinion on things."

So the flyer a public service announcement or a recruitment tool? We met with the White Knights in Tupelo, in a small shed that couldn't fit more than 10 grown men. Still, they insist their numbers are up.

28-year old Steven Howard, a member of the KKK claims, "We have members knocking down our door everyday we have to tell the people we're not accepting memberships anymore."

Howard says it was a member of his Tupelo based KKK organization who dropped the flyers in the Allendale Cove subdivision, during what they call a night ride.

He says the KKK despises sex offenders, among others and insist the flyers are a public service but nothing more.
- Who don't you dispise, except white rednecks?

Howard says, "Everybody needs to be aware on a sex offender if someone is offended about somebody passing out something on sex offenders in your community because it was KKK on there then in my book you ain't much of a person."

But Fox 13 was alerted to a second KKK flyer, about 2 and half miles away from the Allendale Cove neighborhood, that clearly asks people to join the White Knights.

Mark Potok with the Southern Poverty Law Center or SPLC says, "This is a group with very few members they're certainly laying when they say people are breaking down the door to join the group."

The SPLC is an organization that tracks hate groups.

Potok says the flyers are a desperate attempt for the flailing group to gain members.

At its peak in the 1920's the KKK was at 4,000,000 now there are about 5,000 nationwide, the White Knights make up a small portion of that.

Potok says, "these are rag tag little outfits at the fringes of society that have very little say so and are desperate to recruit members because at the end of the day members from them mean dues and dues means money goes to the leader so the leader does not have to work a regular job like the rest of us."

The Klansmen we spoke with wouldn't say how many are in their group but insist they have plenty, they also claim they're not a hate group and are no longer violent.
- Yeah right!

Howard says, "but if somebody woke up at 12 o'clock at night and you were a sex offender or wife beater and you wake up in the middle of the night and 20 robed Klansman were standing in your yard I believe I'd be scared." Reporter says, "Have you done that before?" Howard laughs says, "I never have, no."

But the SPLC says the only thing the KKK has changed is that its members are now just cloaking their racism and hatred as mere "civil rights for whites".

Potok says, "i think their claims are utterly ridiculous. These are people who for years have been asking for money for Edgar Ray Killen the murderer of Mississippi civil rights workers in 1964 so they can go on as long as they want to renounce violence and so on but it's simply not true."

As for the flyers, Olive Branch police say there's nothing they can do. Since the flyers are in bags, held down by a rock, it's not considered littering and the message itself is not illegal.

Potok says, "What they say in these pamphlets is perfectly protected by 1st amendment and they have the right to say it that said, I think it's good for a community to be aware this is going on rather than to act like it's not."

Now the president of the Allendale Cove Homeowners Association plans to send out his own flyers, notifying residents of nearby sex offenders in an effort to keep the neighborhood on the inside and the KKK out.

Robinson says, "Those type organizations we don't want around here because they're bad for the neighborhood, bad for the community. We're tight knit and we'd like it to stay that way."

When asked why they drop the flyers in people's yards, the KKK says they don't want to go door to door and it's a federal offense for them to put them in mailboxes.

The Olive Branch police say they've reported the flyer incident to the fusion center in Nashville that tracks possible terrorist-related activity.

The center is operated by homeland security.
