AL - Alabama Anti-Clustering Law (HB 85) Public Hearing: Affects Registered Sex Offenders

This Wednesday, 2/27/13 @ 1:30 pm, there is a public hearing on Alabama's HB 85, an anti-clustering law that will impact all registered citizens in the state living in multi-family units, halfway houses, and any living within 500 feet from another registrant.

If you are close enough to Montgomery, AL to attend and speak out, I encourage you to do so. I want to go but it is impossible on such short notice to raise $250 for a bus ticket in this short amount of time. So I'm asking you, if you have anyone who can be there to oppose this bill, please do so now!

(I'm annoyed with them doing this on such short notice, it caught me off-guard with no time to prepare a trip, so I'm hoping to drum up support by getting people to attend this)

IN - HB-1204 - New Sex Offender Bill

The following was sent to us via the contact form and posted with permission.

All:

We have an ugly bill (HB-1204) in the second house for vote. It's already passed the first house of Representatives.

The bill is two part:
  1. This bill is set to NOT allow a registrant from having information taken off the registry EVER! This bill will only allow a registrant to have their addresses taken off permanently! A registrant will FOREVER have to keep pictures updated for the public registry!
  2. This bill will allow Romeo and Juliet Offenses to be taken off the registry, but then again, from what I am understanding, just their addresses.

When I talked to several attorney's, representatives and a senator, they were trying to sugar coat it by saying that after ten years a registrant can petition to be taken off the registry! Whooopie DOO! If your pictures and names remain on the registry for life, WHO CARES?

PLEASE call, fax or write your representative in OPPOSITION to this bill, ASAP before it's voted on in the House of Senators!

URGENT - The PROTECT IP Act Is Very Real and Very Bad — Call Now to Block It

The PROTECT IP Act (PIPA) is the evil step-sister of the Stop Online Piracy Act (SOPA), the much-criticized Internet blacklist bill introduced in the House last month. They’ve got a lot in common — both bills would allow the government and private rightsholders to censor the Internet for Americans, and both bills have faced strong opposition from regular citizens, business leaders, and public interest groups.

In one way, though, PIPA is much worse: while SOPA is still in the House committee stage and has been the target of extraordinary public opposition, PIPA is already out of committee and poised for consideration of the full Senate. That means PIPA is a few dangerous steps further along in the process of becoming law. And with only a few weeks to go in this legislative session, the Senate may try to rush the bill through before the public has a chance to respond.

We're not going to let that happen. Despite their efforts to push this through under the radar, folks who care about the Internet and innovation are tracking this bill and getting the word out. You can help, in an old-school and very effective way: Pick up the phone.

Right now, the best response to this threat is to let your Senator hear your voice, explaining why you as a constituent think PIPA is such a bad idea. That’s why we’ve joined with many other public interest groups, including Public Knowledge, Fight for the Future, Demand Progress and others, in asking the public to call in to the Senate.

Even if you’ve already used our action alert (and thank you), please take a few minutes now and get on the phone with your Senator’s office. Let them know that Internet censorship is unacceptable.

URGENT - OH - People off the registry are popping back on it?

It has been brought to our attention, that many in the state of Ohio are noticing that when they check the state sex offender registry, after they have been removed from it, are now seeing themselves back on the registry.

So it is advised, that if you live in this state, to check out the state and county registries, and if you have been removed from the registry in the past, by a court order, or due to the Bodyke decision, then you need to contact the police and Attorney General.

You should send an email or even better, a fax to the Attorney General's office so you have it documented in writing. (Fax is the best, if you can, most faxes get read, emails can tend to vanish into the spam folder, or other.)

Someone did call the local sheriff, for themselves, and the sheriff said that they should not be on the registry and he would take care of it.  He also said they are having major syncing problems with the databases, which are using the Offender Watch system, and hopefully it should be fixed soon.

You need to keep watch on this, for awhile anyway.  Some people have seen themselves on it, off it, then back on again.  So keep vigilant and contact the Attorney General and local sheriff, until they get this fixed.  And make sure you have a paper trail that you can use in court, if needed.

We are writing with an additional request. Can you please contact our office if you meet ALL of the following criteria?

  1. You must register as a sex offender in Georgia for an offense that occurred on or after July 1, 2006;
  2. You wish to volunteer at a church or participate in religious activities at a church or other place of public worship;
  3. Since June 1, 2010, a law enforcement officer (e.g. sheriff’s deputy, probation officer, or parole officer) has discouraged or forbade you from volunteering at church or participating in religious activities.

If you meet all these criteria, please contact our office as soon as possible.

We do not have any additional news about the lawsuit at this time, but we will be sure to post any updates as soon as we know of them.

The U.S. Justice Department has proposed major regulatory changes to the Adam Walsh Act, a 2006 federal law requiring all states to crack down on sex offenders by July or risk losing hundreds of millions of dollars in federal grant money.

The proposed changes, which were posted in the Federal Register on Friday (May 14) and face a two-month public comment period, address some of the most controversial provisions of the law, which many states have criticized as cost-prohibitive and overly strict.

Named after the murdered 6-year-old son of “America’s Most Wanted” host John Walsh, the Adam Walsh Act dramatically ramps up criminal penalties for sex offenders who fail to register with authorities, and requires states to group offenders into “tiers” based on the severity of their crimes. States also must include more personal information about sex offenders that appears on public registries, such as their home and work addresses.

If states do not comply with the law by July, they will lose 10 percent of their funds under a congressional grant program that pays for local anti-crime initiatives, including police salaries.

As Stateline has reported, however, many states disagree with key provisions of the law that they see as too strict, including a stipulation that some juvenile sex offenders as young as 14 be placed on public registries. In Delaware, as the Wilmington News-Journal recently reported, some offenders as young as 9 are listed on the public sex offender Web site. Youth advocates and others have said that posting images and personal information of juveniles can lead to harassment (same for adults), and that juveniles should not be grouped with more serious, adult criminals.

The changes proposed Friday give states the discretion to decide if they want to include juveniles on their registries.

Under another proposed change, sex offenders whose crimes pre-dated the Adam Walsh Act, and who have exited the justice system, would not be forced to abide by its registration requirements. While courts have found the provision constitutional — holding that registration is not a new criminal penalty but a civil, regulatory requirement instead — states have argued that it is overly burdensome to track down and register sex offenders who already have served their time and re-joined the population. The Justice Department recognized that concern, giving states “greater latitude” not to register certain offenders.

It may not be possible for jurisdictions to identify and register all sex offenders who fall within the (Adam Walsh Act) registration categories, particularly where they have left the justice system and merged into the general population long ago,” the new rules say.

Only one state — Ohio — has complied with the Adam Walsh Act so far (not exactly). Several others have asked for a one-year extension to meet the law’s demands. U.S. Attorney General Eric Holder (Contact) already has granted all states a one-year extension, underscoring the difficulty states have had in complying with the law.

While there is broad political agreement on the overall goals of the Adam Walsh Act, the changes proposed Friday show that states’ concerns are being heard in Washington, D.C. Members of Congress also have acknowledged that they may have overreached with the legislation.

I don’t think anyone disputes the goals of the Adam Walsh Act,” U.S. Senator Olympia Snowe (Contact), a Maine Republican, recently told the Bangor Daily News. “But there are many states having a hard time, as is Maine, in complying with the law, and we should look at what the states are saying.”

Experts from across this broad field, including corrections, victim advocates, therapists, law enforcement, reentry professionals, and more, will be addressing some of the hardest questions surrounding how we can keep our communities safe while maintaining sound public policy and a humane approach to sex offender management.

Washington – President Barack Obama will make a special appearance on AMERICA’S MOST WANTED’s milestone 1000th episode, airing this Saturday, March 6 (9:00-10:00 PM ET/PT) on FOX.

John Walsh, host of AMW since the show’s inception 22 years ago, sits down with President Obama to discuss some of the administration’s crime-fighting initiatives and the impact that the show has had on thousands of victims and millions of people in its 22 years and 1000 episodes on the air. The President also discusses his administration’s support of state and local law enforcement, including the Recovery Act’s $4 billion that was allocated for state and local agencies. Additionally, President Obama talks to Walsh about his administration’s initiatives to go after and prosecute “white collar” criminals – crimes that John Walsh and AMW have also focused on recently.

As a long-time advocate for America’s children – since his 6-year-old son Adam was abducted and murdered in 1981 – Walsh has fought hard for countless pieces of victim and child protection legislation, and most recently, the Adam Walsh Child Protection and Safety Act, which was signed into law in 2006 on the anniversary of Adam Walsh’s abduction and murder. Walsh tells President Obama about the need for Congress to fund this act that created a national sex-offender registry to go after the estimated 100,000 convicted sex offenders who are in non-compliance and have disappeared. President Obama tells John Walsh that his administration will work to have the act funded.

To date, AMERICA’S MOST WANTED has helped capture more than 1100 fugitives, including 17 from the FBI’s “Ten Most Wanted” list. The series has also reunited 43 missing children with their families, which Walsh says is his “proudest achievement.”

THE BEST WAY TO REACH THE PRESIDENT IS BY FAX!

Constitutional Fights spoke to a live person at the White House who expressed interest in our concerns about the Adam Walsh Act and how it violates constitutional rights of 700,000 Americans. Granted, these secretaries know nothing about the Act, but she gave potentially useful instructions on how to communicate effectively to President Obama on this issue.

She said to FAX A ONE PAGE OUTLINE summary sheet to 202-456-2461.

You can email but faxes will be MUCH more effective she said, because they receive millions of emails.
  • At the top of the page, put a clear subject line- re: Adam Walsh Act.
  • List clear concise bullet points, not narrative. She said outline form is much more likely to be read than a narrative story.

According to the secretary, faxes are more useful and will more likely be seen, so if you have a fax, or can get access to one, use it! If you use email, it may get buried and lost, since they receive millions of emails.

You know the bullet points to make: constitutional violations of Ex Post Facto/Retroactivity, Separation of Powers, Breach of Contract, ect, how it damages families and children of offenders, how it imposes life-long registration to many who committed a crime decades ago, ect..

I remember the day I had enough. The thought of living under these laws and with the daily stress was overwhelming. It was bad when I cleaned the trash up out of my yard after people drove by screaming obscenities at me. I was shaken from being approached by my neighbor who was calling my husband a child molester when he isn't. I was terrified when a stranger pulled up across the street from my house and took pictures of my son and I out in the yard. I was humiliated when we were ousted at a nearby church we visited. I was upset when I had to move my child to another school for the second time. Finally, I had enough when a woman spotted my husband at the store with my son and called the police because my son was wearing his adorable cub scout outfit and she felt a sex offender wouldn't be anywhere near children. When it reached my child in a way that hurt him, I had enough. He no longer participates in the cub scout program because we either have to make my husband known to all or not come. My husband picked him up from scouts one day and ran an errand for me and now scouts is over...my son can't go to scouts without everyone knowing and he can't go if everyone knew. He misses it and there is nothing we can do...he can't go because his daddy is a sex offender.

The upcoming conference for sex offender reform in Atlanta is my opportunity. It's my chance to let my legislators know that these laws affect me and my son too. It's my chance to share with others the pain and hurt it has caused to innocent people. I've spoken with so many young men who made stupid choices who feel life is not worth living. There is no future and no hope. The world views them all as child raping kidnappers who deserve all the humiliation they have received even when they had consensual sex with an underage minor...some of them are now married to those they "offended" against and are trying to raise their children and lead as normal of a life as they can under the shame of the registry. Could you imagine a mom taking her children to school with a "sex offender" license plate on her car because her husband is on the registry...that is the future that they and I have to look forward too. I've heard people say that it is unfortunate that those who really didn't hurt a child have to register but the public has the right to know who is dangerous. Seriously? People vote for lawmakers on the basis that they continue to make laws that are unconstitutional and put innocent people in danger and so they feel no remorse for those whose lives are ruined so they can "feel" safe? Did my son feel safe on the bus when the kids were telling him his dad was a bad person? Are we safe from the stranger who took our photograph? Are we safe from those who think the worst of our husbands and are capable of burning our house down with us in it? Our address and my husband's sin is on a national registry...are we safe? That is what is happening across America...but you won't hear about it on the news because there is no sympathy for the sex offender and his family.

So I have a chance to tell the world my side of the story they will never hear unless I tell it. I have a chance to tell them that my husband did something stupid and he is sorry for what he did; he has no desire to hurt children. I have a chance to tell them that they are being fed lies from rising politicians who use fear to obtain their vote. There is real research out there and the lies John Walsh and Nancy Grace spout out are based on hatred and not facts.

We sent out thousands of letters. My friend from SOIssues has helped us spread the word to the thousands of members on his site...but the response is less than 10%. We've got enough attendees to make a statement...possibly even to reach a national level...but will it be enough to make change...real change that could come soon? Why are we not filling up a stadium with people who have had enough and who want to learn how to make an impact and a difference? How much worse does it have to get before they will come and support reform? We can't get those unaffected by the registry to stand up...so why won't they who are? We couldn't reach everyone, but for the ones we did, I just don't understand why they won't come.

MD - HELP!! It's the AWA!! Maryland Needs some legal minds, experienced activists

The Maryland House and Senate have at least 30 Bills dealing with sex offenders, which were introduced just in the past week or two. Most of them will be heard for the first time on February 23. I didn't try to do a point-by-point on these, but I feel pretty sure that if they are all passed, Maryland will be fully compliant with the Adam Walsh Act.

Our protest group is very small (less than 10), very new at activism, and barely organized! We need some folks who have "been there - done that" to help us focus in on what we can realistically do by way of speaking out about these Bills during the session. SD - Committee on sex offender registry laws to meet (URGENT)

PIERRE (AP) - A legislative committee set up to review state laws on the sex offender registry will take public comment on Tuesday.

The Sex Offender Registry Study Committee meets in Room 414 of the Capitol beginning at 9 a.m., with public testimony beginning at 1 p.m.

Everyone including citizens, sex crime victims, sex offender registrants, law enforcement officers, prosecutors, defense attorneys and neighborhood watches representatives are invited to give their input. Public comment is expected to run well into the afternoon.

The ACLU of Eastern Missouri wishes to speak to persons required to register as a sex offender in Missouri and who believe they may be impacted by a recently placed statute imposing certain duties on registered sex offenders on Halloween.

If you live in Missouri, PLEASE do contact the ACLU on this, as we want as many as possible on this suit! Where the ACLU is involved, the chances of a favorable ruling is increased, and this may prompt them (as they get to know their clients) to further challenge the unconstitutional laws we are all concerned with!
