IN - Pence signs into law changes to sex offender registry

Changes are coming to Indiana’s sex offender registry, thanks to a new law signed by Gov. Mike Pence Thursday.

HEA 1053 (PDF) requires the Indiana Department of Correction to remove information from the online public portal of the sex offender registry relating to a sex or violent offender who no longer is required to register or is deceased. The new law also adds the vehicle identification number of the vehicle owned or regularly operated by the offender to the information he or she is required to provide for sex offender registration. Driver’s licenses or ID cards must contain the offender’s current address and physical description.

Among other things, the law also merges the offense of criminal deviate conduct into the crime of rape and repeals the criminal deviate conduct statute, effective July 1, 2014.

The introduced version of the bill was prepared by the Criminal Law and Sentencing Policy Study Committee.

Pence also signed HEA 1159 (PDF), which limits the liability of a public school or an accredited nonpublic school that provides community-use physical fitness activities to the general public.

The governor still has dozens of enrolled acts before him with a signing or veto deadline of Saturday, including HEA 1393 (PDF) on judicial technology and automation and HEA 1320 on workers’ compensation.

- We believe this is part of SORNA (PDF), so if states want to comply, then they have to put juveniles on the registry.

Oklahoma is one of those states.

In Oklahoma you can be put on their as young as 15.”

But a recent Human Rights Watch Report claims placing juveniles on a sex offender registry does more harm than good and calls it a violation of human rights.

Teenagers sometimes do really stupid things and to be punished for the rest of their life is pretty harsh,” said Slane.

Slane said in Oklahoma juveniles end up on the registry for offenses ranging from sexting all the way to rape.

In some cases they face lifetime registration for something they did when they were 14 or 13 years old.”

Something he said can ruin a young person's future.

There's certain jobs they’re not going to get. They will never have the chance to be a fireman, a police officer or a teacher because of that one indiscretion.”

The judge should be able to put them in there regardless of their age,” said State Senator Kyle Loveless.
- If it was your child on the list, we're sure you'd say otherwise.

Loveless said the registry does not violate any human rights.

They're responsible for their actions so they should be responsible for their crimes.”
- They are children, not adults!

He said regardless of age the sex offender registry is there for a reason.

To keep them away from our kids. That’s what it comes down to.”

Some parents we spoke with are on board for putting minors on the list.

I would want access to the information,” said mother of 7, Elizabeth Hannah.
- And we'd like access to ALL criminal records on an online registry for the world to see.

Others say it goes too far.

That means in today’s world there’s no chance for that young man or woman to be redeemed after that. They’re basically lost to society,” said parent Ed Sniffin.

Hundreds of children have been arrested in the North over sex crimes, with experts blaming online pornography

A shocking number of children have been arrested in connection with sex crimes in the North, with experts blaming online pornography.

In some cases those arrested were as young as six, a Sunday Sun investigation has revealed.

Our probe shows how almost 500 children aged 17 and under were arrested for sexual offences according to police data, 20% of which were formal investigations into reports of rape.

Of those arrested, more than 140 were 13 or younger - with 40 of those being on suspicion of rape.

Charity bosses told the Sunday Sun that they have seen a national trend of an increase in these types of crimes.

One North MP last night said the alarming figures painted a picture of “childhood innocence destroyed”.

However, only a handful of those arrested were convicted of offences. Nationally, only 400 people aged between 10 and 17 were convicted of sexual offences between September 2011 and September 2012.

This amounts to just 7% of the 5,700 convictions for sexual crimes committed by offenders of all ages over the same time period.

This is because a large number of them are below the age of criminality, which in this country is 10, whereas in some cases the accused will have accepted cautions, or the Crown Prosecution Service (CPS) will not have pursued a prosecution.

Experts blamed the shocking figures on the increasing availability of hardcore pornography on phones and the internet.

A spokesperson for the NSPCC said children they work with often appear to be acting out what they have watched.

And young people were more exposed to the “powerful influence” of online pornography than ever before, according to Pat Buckley, NSPCC service centre manager for Newcastle and Middlesbrough.

She said: “There does appear to be a link between incidents of this nature and watching hardcore porn, although more longer term research is needed."

We should also not forget that the young people perpetrating this serious abuse have often themselves experienced significant emotional deprivation and other forms of abuse.”

While the vast majority of those reported for sexual assault in the North were boys or male teens, a handful were teenage girls. Other offences investigated among the region’s children included making indecent photographs, indecent exposure and incest.

In more than 100 of the incidents probed by police, the alleged victim was 10 or under.

North Tyneside MP Mary Glindon said the Sunday Sun’s investigation, in particular the cases where those arrested had not even reached adolescence, painted a picture of “childhood innocence destroyed”.

Mrs Glindon, who sits on an all-parliamentary party group on body image, argued the mainstream media also had to take some responsibility for the disturbing figures.

It’s not just the internet,” she claimed. “Even with something as popular as the X-Factor, everything’s so sexual. It leads children into thinking, what’s next? Young children just don’t look like young children anymore,” the Labour MP said.

Simon Hackett is professor of applied social sciences at Durham University.

He has led academic research into children who have sexually abused, and has worked as a practitioner in child welfare. “In my research, 50% of victims had experienced abuse themselves.”

If you’re trying to find trigger behaviour, looking at porn has been a very significant influence.”

Early sexualisation can be a trigger for this kind of offending behaviour.”

Northumbria reported 273 incidents of youths being arrested for alleged sexual assaults against people under 18 over three years, while in Cleveland the figure was 71.

A spokesperson for the force said the number of children under 13 arrested for sexual offences had decreased over the last three years, though figures across the North remained steady.

North Yorkshire reported 79 youths arrested for sexual assault, while Cumbria made 56 arrests. Durham only supplied information for last year, when 22 arrests were made.

TN - Lawsuit for former deputy (Dexter Morris) accused of rape may be settled

A lawsuit filed against a former Hamblen County sheriff's deputy convicted of forcing female drivers into sexual acts could be settled out of court.

Dexter Morris was convicted in 2010 of forcing female drivers to engage in sexual acts during routine traffic stops. A judge sentenced him to more than 15 years in jail.

A woman who claims Morris raped her after a traffic stop later filed a $20 million dollar lawsuit against Morris, former sheriff, Otto Purkey, and Hamblen County.

The lawsuit seeks a jury trial, but all the parties told a judge they would consider using mediation to come to an agreement outside of court.

If an agreement is not reached within 20 days of the final pre-trial conference, then the case will go to trial in February of next year.

INDIA - India should think twice about its sex offender register

India surely needs to take action against sexual violence, but the experience around the world is that sex offender registers can do more harm than good, writes Ali Winters.

As the ashes of a young woman's traumatized body are scattered, we are left to face the horror of the sickening gang rape which led to her death.

How the Indian government responds to this hellish act and how they answer their citizens' outrage is under intense international scrutiny.

In response to the eruption of public protest, the Indian government is desperate to be proactive. The six accused men have been arrested and are facing a murder charge.

Thus far, there is only one other tangible action that's risen above the white noise of fast-track rape courts, harsher penalties, and a parliamentary commission - a public sex offender register.

The minister of state for home affairs, RPN Singh, has said of the register, "We are planning to start it in Delhi. Photographs, names and addresses of the rapists will be uploaded on the Delhi Police as well as NCRB (National Crime Records Bureau) website."

The database will expand to identify and locate every convicted and released sex offender in all of India. But no one truly believes an online register is going to end a problem that manifests through deeply ingrained attitudes.

When the prime minister's own son, Abhijit Mukherjee, a politician himself, publicly stated that [the protesters] are "highly dented-painted" women who go "from discos to demonstrations", then yes, India has a problem.

But far from being the solution, could a public online register make things worse?

In the ensuing anger, fear and vengeance of the gang rape murder, indeed it will.

Shortly after the woman's death made headlines across India, a large group of villagers from the North East attacked and killed four youths and a middle aged man accused of "frequently teasing the women and girls of the village".

This same mentality is what killed Jesus!

Last week, homemade bombs were planted in Ravidas, the slum town home to the six accused gang rapists.

Progressive social norms coexist with archaic cultural beliefs in India. Giving a sex offender register to the uneducated masses without the instruction manual will cause a cycle of violence and hatred that will feed on itself.

There is undeniable horror in what is happening in India. But there is no evidence that an online sex offender register will be effective in protecting women and children.

The social experiment of sex offender registers has played out nowhere more lavishly and hysterically than in the United States. Garish crime tabloid newspapers are spewed out across the country with photos of the convicted, but also of people who have only been charged, implying guilt before innocence.

The courts and police hand over information to private publishers who make their profits, spreading names and addresses with panic and hatred.

In Louisiana, sex offenders are reserved for a particularly ruthless regime of public notification. This includes the usual website, but more impudent requirements, such as taking out newspaper ads if released offenders change address.

Released offenders must also carry a special identification card that includes the words "sex offender" in orange capital letters. It's to be on the person at all times. They can be imprisoned for six months for failing to carry the card.

More than 12,000 women in Jackson County are victims of rape and it's a problem nationwide. But a new program in southern Oregon is aimed at bringing more attention to potential sexual predators looking for their next victim at the bar.

At Louie's Restaurant & Bar in downtown Ashland a sign hangs warning customers of the possible dangers of sexual assaults.

But knowing the behaviors of sexual predators is what it's all about.

Susan Moen is the Executive Director for the Jackson County Sexual Assault Response Team.

She came up with a program in southern Oregon that would help educate bar staff on suspicious behaviors of sexual predators.

"I saw a conference in Boston, where a group was doing a program training bartenders to look for potential predators," Moen said.

"I thought it was a great idea and brought it here."

Moen says the idea of the program isn't necessarily to stop the predator directly, but instead to shift the predator's focus elsewhere.

Louie's Restaurant and Bar is the first establishment in the state to join the program.

Bar owner Melissa Jensen says she was excited to jump on board.

"We all have sisters, daughters, mothers and girlfriends, and this is an issue effecting all woman and all men and I have a unique oppurtunity to make a diference," Jensen said.

Jensen also says while she, herself, hasn't seen any signs of potential predators at her bar, she says that if the new program helps to save just one life, it's worth it.
- If you really cared about "saving one life," then why don't you go out and help the homeless, or those who are hungry in this country and others?

Moen also tells NBC 5 that if the program is successful in Southern Oregon it could go statewide.

WORCESTER — Jury selection got under way today in Worcester Superior Court for the retrial of a former police officer charged with raping and assaulting a woman five years ago after offering her a ride home from a bar.

Jason D. Briddon, 39, a former part-time Rutland police officer, has pleaded not guilty to charges of rape and assault and battery with a dangerous weapon in connection with the alleged May 1, 2007, sexual assault.

The alleged victim told authorities Mr. Briddon raped and assaulted her after offering her a ride home from Ralph's Chadwick Square Diner on Grove Street. She said she accepted Mr. Briddon's offer for a ride after she drank from a beer he had given her and began feeling sick and dizzy.

Instead of driving her directly home, she said, Mr. Briddon drove her to a building in the William Street area, carried her inside, threw her down on a box spring and raped her.

Mr. Briddon, of Westminster, denied the allegations.

The first trial ended in a mistrial on March 13, 2009, after a 12-member jury was unable to render a unanimous verdict in the case.

In February 2010, Mr. Briddon was convicted of unrelated charges of raping and beating a prostitute in Worcester in 2008 and was sentenced to 10 to 12 years' imprisonment. He is seeking a new trial on grounds that his family was excluded from the courtroom when the jury was being chosen for the 2010 trial.

MA - Salem police lieutenant (Matthew Desmond) arraigned on rape charge

A Salem police lieutenant was arraigned Tuesday afternoon on a rape charge at Salem District Court in connection with alleged incident that occurred on June 20.

Lt. Matthew Desmond, 41, pleaded not guilty and was ordered held on $5,000 cash bail by Judge Allen Swan. His attorney said he vehemently denied the allegations.

According to the police report, the victim - who is known to Desmond - was watching the defendant's children, her own children and the children of a mutual friend at Desmond's home in Salem while Desmond and his wife were at work.

The victim alleges that Desmond returned home from work, brushed her breast with his hand, and then reached under her dress.

According to the police report, the victim described Desmond "as having an almost mean look to him while this was going on." When she told him to stay away from her, "it was like he snapped and went into panic mode and started saying 'Don't say anything, don't say anything.'"

Desmond vehemently denies the charge, according to his attorney, Thomas Drechsler, and alleges that the victim initiated contact with him months before this allegation was raised.

"My client absolutely denies the allegation," Drechsler said in a phone interview Tuesday afternoon. "He's looking forward to clearing his name, and we'll let the process sort itself out now."

One man known to both the victim and defendant stated to police that Desmond described the June 20 incident to him as consensual, according to the police report.

The incident was officially reported to police on June 26, and a formal investigation was launched. Desmond turned himself in Tuesday morning immediately upon learning of the charge.

"The Salem Police Department takes any allegation against a member of the department very seriously," Salem Police Chief Paul Tucker said in a statement. "Lt. Desmond has been placed on administrative leave and the matter will now move forward in the court system."

According to Drechsler, the case is out of the jurisdiction of the district court, and must now go before the Essex County Grand Jury. A hearing has been set for August.

The jury deliberating the fate of a former Westminster police detective accused of raping a waitress has rejected a controversial "Zoloft defense," finding the defendant guilty of all seven charges.

The jury of eight women and four men began deliberations late Tuesday and reached the verdict Wednesday morning. It found the defendant, Anthony Nicholas Orban, a Marine veteran of the Iraq War, guilty of two counts of rape, two counts of forced oral copulation, two of sexual penetration with a foreign object, one count of making a criminal threat, and a sentence enhancement of using a firearm in commission of a kidnapping.
- Why are juries always stacked against someone?  Why not have 6 men and 6 women?

Orban faces a sanity hearing before sentencing.

Defense attorney James Blatt had argued that Orban was rendered "unconscious" by use of the antidepressant, and therefore was not responsible for his actions in the brutal 2010 attack in Fontana.

A defense psychiatrist testified that Orban had stopped taking the prescribed antidepressant, then resumed it at full dose, provoking a psychotic break during which he was not fully aware of his actions.

But prosecutors said such a defense was "baloney" that ran counter to medical consensus on the drug's effects. Orban had been out drinking and seeking sexual encounters before he kidnapped the victim at gunpoint and made her drive to a Fontana storage facility, where he raped her.

"He was a highly trained officer who wanted to have sex. He had sex on the mind. Don't forget that," Deputy Dist. Atty. Debbie Ploghaus told jurors in her closing arguments earlier this week.

The woman, then 25 and working as a waitress at Ontario Mills Mall, testified that Orban chambered a round in his semi-automatic service pistol, shoving the barrel deep into her mouth as tears rolled down her cheeks. "He said if I cried, he would kill me," the victim told jurors. "Then he pulled the gun out and said, 'I think we'll continue this in the desert.'"

When Orban was distracted by an incoming cellphone call, the woman said, she jumped out of the car and ran to safety at a nearby liquor store.

Orban's attorney, James Blatt of Los Angeles, said the assault ran counter to a life spent protecting community and country. The only plausible explanation for the defendant's behavior, Blatt argued, was the potent effects of Zoloft, which sent Orban spiraling into an "unconscious" delirium. "At the time he was not aware, not aware of the torturous things he had done,'' Blatt told the jury.

Is Crying Rape The New Guilt After One Night Stands?

Let's get this out of the way: rape is a horrible, horrible crime committed against a person. It's a war crime in our community, it's a tactic that's been used since the dawn of humanity to control and eradicate tribes in times of war, it's a tool for shame, and it's a tool to enforce power.

Rape is not about sex.

STORY: Investigators Don't Believe Kelly Rape Accuser!

That said: Is rape also used to assuage guilt when someone is busted for cheating? Is rape an escape clause? The answer is yes, sometimes it is.

Like everyone else in the NYC area, I was shocked when I learned that Greg Kelly, son of police commissioner Kelly and host of a FOX news morning program, was accused of rape. Days prior to this news, I listened to a story a friend told about a visitor from the UK who was accused, arrested and charged with rape in a NYC nightclub two weeks ago.

The friend received oral sex from a young lady in a bathroom but when the young lady's boyfriend saw her talking to the dude, the boyfriend became suspicious. Questioned about their association, the lady said she was raped.

I thought of this case when I heard about Kelly's. Actually I thought, "this lady probably was disappointed that she was a one night stand and was hurt when she realized Kelly had no interest in her beyond their tryst in her law office." Throw in a boyfriend situation and we have a rape case.

It's reductionist and simplistic, but it's likely that's what happened. Whatever the case may be, no one rebounds after being accused of rape. When Kelly gets back to work, all people will think about when they see him on TV is that he was accused of rape. The woman will get back to living life anonymously.

When Dominique Strauss-Kahn, the former head of the International Monetary Fund, was accused of rape last year, it made worldwide news. His accuser, a hotel maid who was basically a hustler, cried rape after having consensual sex. I think this lady, with dollar signs in her eyes, thought she saw a sucker after she realized who this white man was; and wanted to cash in by calling consensual sex rape. The proof is in the tapes she's on describing her encounter to a "friend" in jail.

I've read accounts of soldiers being tried for rape because the woman didn't want to be late for work, police arrests, and less. One Hofstra University student invited five men to have sex with her. She accused them of rape because she didn't want to be labeled as a tramp by her boyfriend.

Why? Why are women accusing men of rape when, in some cases, it's not? I think it's an issue of defense, power and fear of being labeled.

As marginalized members of society, I think some women, who after being used for sex by men, or willingly let themselves be used for sex but then feel shame, figure out that crying rape is the only way to empower themselves out of emotionally charged situations, situations that some of them have willingly agreed to participate in.

Situations like cheating. If you are cheating on your boyfriend, husband, whatever, you shouldn't be with that person in the first place. These cheaters would rather destroy someone's life than admit that they f---ed someone other than their man whom they don't love. How crazy is that? Stir crazy.

And guess what? These false accusers will not be prosecuted.

CA - Former Police Cadet (Jose Luis Capacete) Arrested On Rape Charges

SANTA ANA (CBS) — A former police academy cadet and armored car company employee faced charges of sexually assaulting a prostitute, police said Wednesday.

Jose Luis Capacete, 39, of Baldwin Park, primarily targeted illegal immigrants and may be responsible for multiple rapes in Orange County, said Santa Ana police Cpl. Anthony Bertagna.

Capacete made his first appearance in court Tuesday on felony charges of sodomy by force, oral copulation by force and two counts of sexual penetration by a foreign object, according to court records. His arraignment was postponed until Feb. 9.

KNX 1070′s Mike Landa reports a search of the suspect’s home uncovered several pieces of potential evidence including three handguns and a Taser gun.

Police also found “items that belong to six females not related to him,” Bertagna said.

Capacete was being held without bail.

He is accused of abducting a woman walking in the 300 block of South Harbor Boulevard on Dec. 24, taking her in his 2001 Chrysler Town and Country mini-van to the 1600 north block of Harbor, where he allegedly sexually assaulted the woman, Bertagna said.

He bound the victim in the car, took her clothes off and when he was done with her he pushed her out of the car nude and threw her clothes on top of her,” Bertagna said.

Police connected Capacete to the crime through an undisclosed piece of evidence that ended up on the pile of clothes, Bertagna said.

Capacete was arrested Friday, Bertagna said.

He works for the Brinks company in Garden Grove, but it wasn’t immediately clear whether he was a security guard, Bertagna said, adding the suspect does have a gun permit.

Capacete also put himself through a police academy and has been applying for law enforcement jobs, Bertagna said. He has a prior arrest for solicitation of prostitution, Bertagna said.

Santa Ana investigators suspect he may be involved in another attack in Garden Grove, and they are working with Homeland Security officials on another case, Bertagna said.

After a search of his home on Friday, investigators suspect there may be several more victims, Bertagna said.

Ask anybody who has been in jail and/or prison, and they will tell you, this is the average way police act. Not the rape, but the ego and brutality. All these shows that are suppose to show how it is in prisons will NEVER be able to see how it REALLY is. Cops clean up their acts when they know someone will be filming.

One of the officers made a threat against me and said that he was going to come get me later on. And I remember telling his supervisor the threat this officer just made on me. He said "Mr. Mendoza, you are in LA County Jail. You are in one of the safest facilities around. You have nothing to fear."

Everybody's pod was shut except my pod. And I remember it seemed eerily quiet, and then as I'm looking around I see all the guards dispersing, just leaving. And my pod is still open and i'm wondering what's going on and from of the corner of my eye i see the gentleman, the officer that threatened me earlier, coming towards my cage -- coming towards me. and I just frantically started, I started screaming and yelling, to no avail -- nobody came to my rescue. and he just came in there and manhandled me and stripped me butt naked and sexually assaulted me.

He left me naked, bloodied, and terrified. I remember just being left in the corner, shivering. And when there was a guard change the guard came and he noticed there was something wrong with me. And he even knew my name and he was like "Mendoza, what happened to you?" The moment I told him, he suddenly changed his demeanor and said, "Well, it doesn't look like anything happened to you. You look okay."

There was no forensic evidence taken, no -- it was not treated as a crime at all.
