They say 1 out 3 African American men will experience incarceration at some point of their life. Having only 2 close friends, Brian Banks was that third. On July 8th, 2002 at the age of 16, and on a fast track to a promising college and NFL career, he was arrested on the charges of raping another student on campus.
Awaken by the heavy knee to his back and barked orders of a cop, Brian was forced from bed and stood cuffed in boxers as he was told to quickly pick something to wear. The police were in his room and with guns drawn. Their voices imitating the sound of calm, their actions filled with anxiety. Shit just got real. It was the beginning of a true act of evil. As police took him into custody and from his home, he could only watch as his mother drop to her knees shouting in terror as they lead him, her middle child, out the door. The LA Times and news reports said, “Long Beach Poly High School Football Player Arrested for Rape”. For the next 10 years he will endure some of America’s greatest nightmares, with the question “why”, an answered prayer, and an amazing struggle for vindication.
Brian was, by all accounts, a high school football star. At the early age of 16, Brian stood 6’3″ tall, 225 pounds, and played the position of middle linebacker for the legendary Long Beach Poly High School. In fact, Banks’ physical fitness and his great speed for his size meant he was heavily recruited by a number of NCAA Division I football programs. At the time of the incident, the University of Southern California had offered him a full-ride scholarship. Other universities also expressed an interest in Banks, including Colorado State, the University of Illinois, the University of Nebraska, the University of California – Los Angeles, the University of Oklahoma, the University of Arizona, Michigan State University, Utah State University, and the University of Kansas. It is indisputable that Banks was on the fast-track to a free college education and a potentially successful football career..

Executive Producer Sean Penn proudly presents "Witch Hunt," a gripping indictment of the United States justice system told through the lens of one small town. It's John Stoll's story, but it's also the story of dozens of other men and women who found themselves ensnared in a spiral of fear, ignorance and hysteria. These people are Americans, working class moms and dads, who were rounded up with little or no evidence, charged and convicted of almost unimaginable crimes. All sexual. All crimes against children. Years, sometimes decades later, they would find freedom again, but their lives and the lives of their children would be changed forever. This film shows viewers what the real crime in this case is, not molestation, but the crime of coercion. Viewers hear from the child witnesses who were forced to lie on the witness stand as they describe scary sessions with sheriff's deputies in which they were told -- not asked -- about sexual experiences that happened to them. Their coerced testimony led to dozens of convictions. Many times their own parents were the ones they put behind bars.
Soon after the trials, the children started to crack. They told adults of the lies they'd been forced to tell on the stand and hoped it would make a difference. It didn't and the convicted continued to sit in prison. As the allegations grew more outlandish, California's Attorney General wrote a scathing report on the court misconduct, but instead of being buried by criticism, Kern County District Attorney Ed Jagels thrived, doing what he did best-- putting people away. He boasted one of the highest conviction rates in the country. This strategy served him well. Jagels is still in office today. Through new interviews, archival footage, and unflinching narration by Mr. Penn, the filmmakers construct an intimate film that illustrates a universal point; when power is allowed to exist without oversight from the press, the community or law enforcement, the rights of everyday citizens can be lost for decades. National film critic Marshall Fine says, "This is a chilling story about American law-enforcement run amok and untethered. The New York Police Department has subpoenaed film makers Ken Burns, Sarah Burns, and David McMahon over outtakes of their new acclaimed documentary The Central Park Five. The legal wrangling is part of a case brought by plaintiffs known as the Central Park Five – five men who were convicted for a crime they didn’t commit. Burns and his fellow film makers are releasing a new documentary based on the story that garnered national attention.

In 1989 these five teens from Harlem were convicted as teenagers for the rape and brutal beating of a female jogger in Central Park, New York. The police arrested Kevin Richardson, Antron McCray, Korey Wise, Yusef Salaam and Raymond Santana who were at the park earlier in the evening. The boys were told that if they offered to confess to the rape and beating of the jogger, they would be allowed to return home without a lawyer or parents present. Their rehearsed confessions were used to formally charge the five for the rape even though there was no DNA evidence linking them to the crime or a match of the stories. The five maintained their innocence and were exonerated years later only after a convicted rapist who was serving time confessed to the rape in 2002 and whose DNA matched the crime.
In the documentary, Central Park Five, the freed men who are now in their thirties and forties, talk about the confusion, misconstruing of events by police and the ordeals that they and their families faced over a crime they had no part of. Central Park Five has been nominated for Best Documentary by the International Documentary Association and will be released in theaters at the Landmark Nuart Theater on Friday with David McMahon, Raymond Santana and Kevin Richardson present for a question and answer segment following the two Friday and Saturday night shows.

The movie will expose corruption in every state. The Movie will focus on victims. Corrupt judges and corrupt government officials will be exposed, and we will confront a number of the crooks.
If anyone has ever questioned the story of a person who has expressed the view that they were a victim of the government or of judges, this movie will prove that the odds are that the corruption report was true. In fact, there are probably tens of millions of victims in the United States who never realized what happened to them.
One feature length documentary movie is being produced. It will be shown in theaters, on Netflix, Blockbuster, and other such video places, and the movie will be presented at the Sundance Film Festival and other film festivals.
In addition, videos will be produced for each state and for each type of corruption. Everyone who is interviewed for the film will record a three-minute segment that will be done as testimony before Congress as well as a 30-60 minute on-camera interview with Bill Windsor, founder of LawlessAmerica.com and GRIP, and candidate for the U.S. House of Representatives. The legislators in each state will receive the testimony from those in their state, and the members of the U.S. House and Senate will receive all of the testimony nationwide.
Over 750 people are already scheduled to be interviewed for the movie.

John Walsh - Biography Channel

The other week, there was a post about a documentary featuring John Walsh from ‘America’s Most Wanted’ and father of Adam Walsh (after whom the sex offender law is named). In the documentary, John Walsh admitted to dating his wife when she was 16 and he was in his 20’s. An excerpt from the documentary can be found here: (Full documentary here)
When I was attending the SO treatment program there was another offender in the program who was around 19-20 and was convicted for acts with his girlfriend, who was 15. They were part of the same youth group… someone reported it… he was arrested. In court the girlfriend argued that it was consensual but the judge said she was a minor and couldn’t consent.
There were some people in my program who deserved to be there, others who I believe didn’t, but he, in particular, I felt badly for. Even though he only got probation, his life was ruined. He couldn’t stay over at his mom’s house because a minor sibling was there, he wasn’t admitted to college because of his offense, he kept getting fired from jobs because someone would notice his GPS or co-workers would Google his name and create drama.
After reading about John Walsh his situation has been really bothering me.
In doing my fact checking on the John Walsh documentary, I came across a report on Joshua Lunsford, son of another SO Law activist; Mark Lunsford, father of Jessica Lunsford (after whom another sex offender law is named). The details about Josh can be found here. Turns out Joshua molested a 14 year old when he was 18. He got a few days in jail but isn’t registered.
Absent the obvious conclusion, I wonder why Walsh and Lunsford get to avoid the registry while others don’t. What is the difference between John Walsh dating a minor and the guy in my group? I wonder if they would have advocated so vehemently for these laws named after their family members, if they themselves would have been subjected to them. If society is so concerned about monitoring these types of offenses wouldn’t they be equally concerned about ALL offenders who have committed them?
Considering the “Adam Walsh Child Protection & Safety Act” eliminates the statute of limitations on the prosecution of felony sex crimes against children, wouldn’t it be a perfect illustration of the success of the act if John Walsh were prosecuted under it?

Her looking like she was 21 is no excuse Mr. Walsh, and you should be on the sex offender registry for life, and forced to live in certain places, like under the Julia Tuttle Causeway in Florida! You were 22 or 23 at the time.

Like lepers of biblical times and 'witches' of 17th century Salem, registered sex offenders are the most despised and shunned social outcasts in America today. The picture that the “sex offender” label paints in the mind of the average citizen, however, is often worlds apart from the reality of what the person has actually done. High-profile child murder tragedies and fear-based media sensationalism have led to undeserved stigma, unfairly cruel punishments, and even reactionary violence against people who never (a) touched or raped anyone, (b) posed any kind of threat to public safety, or (c) fit the typical characterization of a child predator, sociopathic deviant, or violent rapist. American Sex Offender portrays multiple sides of the controversy through interviews with registered sex offenders and their families, victims of sexual abuse, probation officers, legal experts, politicians, activists, psychologists, human sexuality experts, and more. Proponents of the current system argue that it keeps families and children safe by informing the public about dangerous predators. Opponents argue that it fails to distinguish between those who pose an actual threat to society - and the majority who do not. An autobiographical element is woven into the story by filmmaker Kevin Scott Foley, who is himself a registered “sex offender”.
