So if the state has made you homeless due to the draconian laws, they will now force you to do community service for $1 an hour? That is called SLAVE LABOR!
Springfield - On Wednesday, State Representative Norine Hammond (R-Macomb) passed legislation out of the Illinois House that will allow indigent sex offenders, who can not afford to pay the $100 dollar registration and annual renewal fees, to instead perform 100 hours of community service.
“This idea was brought to me by the Sheriffs Association who noticed that sex offenders were frequently claiming they were indigent in order to avoid having to pay the required registration fee,” Rep. Hammond said. “Because so many continued to have their fees waived, there was no money available to support the sex offender database and registration system. By requiring 100 hours of community service as an alternative, the thought is that many more offenders will be willing to pay the annual fees.”
House Bill 4670 (PDF) will allow sex offenders, who claim indigence in order to avoid registration fees, to complete 100 hours of community service within 90 days of their required registration date, if community service is available in the area. Currently, sex offenders are required to pay a $100 initial registration fee and $100 for each annual registration. If they can not afford to pay the entire amount at once, a payment plan can be established.
“I am hopeful that this alternative will increase the incentive for sex offenders to pay the fees. Instead of simply being able to claim indigence and not having to face the penalties, they will now have a choice to do 100 hours of community service or pay the fine. I think a number of these folks will choose to pay the fee,” said Rep. Hammond.
House Bill 4670 passed the Illinois House and now heads to the Senate for further consideration.



Any person just can't CLAIM indigency, as the statement in the article alludes to. They have to prove that they are assetless, unemployed, and have no source of income. Also, I thought community service was an alternative punishment as part of a criminal sntencing procedure? So, in effect, this is way past civil regulatory sanctions, and is cruel and unusual punishment. Is there no limit to the relentless, unabated, and indiscriminate trashing of the lives of all registered offenders?????
ReplyDeleteIt is not cruel and unusual punishment, it is ILLEGAL punishment, which by definition, is BEYOND cruel and unusual in the first place. Essentially, it criminalizes a civic action. (In my opinion, the fees should be challenged in court as well for this very reason, but the state is banking (literally) on the fact that no offender has the $$,$$$ to pursue this on his own, and they know the ACLU won't step into the picture for this case.

laws are written, passed and enforced that are completely
ILLEGAL and beyond any rational interpretation of our Constitution and most state guidelines.
Frankly, it seems to me, that a select few sex offenders are being sorted out and used as social/legal experiments in order to further the gain of more control on a group of people who have paid for their ''sins'' and need access back into society not ostracized.
The volley of poorly crafted laws create more harm than good and serve only the dark side of human nature in its
quest for power and control at the expense of a few.
This is yet another urgent reason why a serious coalition must be formed.

This must be in other parts of the state, say the Chicagoland area. Other counties are different amounts, city different amounts. Let alone the cost of having a new I.D. each year costing $30. It is difficult enough to have a person that is bullied or required to register as a "sex offender" to find a job in the first place, WHO is going to let this so-called 'registered sex offender' do community service? The county jail? Probably. Sick of these Nazis wasting our tax dollars. Abusing all human rights and civil rights.
ReplyDeletewhat about disabled offenders who can't work and are indigent? Do they just get sent back to jail? this is wrong. So is the new law in wa state that anyone convicted of certain sex offenses if they are involved in a custody case automatically has to have their time with their child restricted and supervised even if they are the mother and have raised the child since birth no matter the age of the child. judges have no discretion! the change was done without public notice and went into effect Jan 2012.
ReplyDeleteAt what point will SCOTUS determine the registry is punitive? I pray that other states will generate more abusive programs like this in order to prove indisputably and unarguably that the registry has become nothing less than a punitive measure aimed at inflicting damage and ostracizing upon RSO's and the families thereof.
ReplyDeleteIf the citizens of Illinois want to have a Registry in order to protect their babies than let them pay for it. "It's a small price to pay if it saves even one baby!" Right?
BTW, is anyone aware of a penalty if an RSO is indigent and refuses to work the 100 hrs. of community service? Or is this just more govt make-work and another toothless dog?
Don't they know Community Service is a Court ordered punishment? To legislate such in lew (spelling?) of payment for indigent sex offenders is pure punishment without ever going to court for a crime. Guess

yea another socialist draconian law that is unconstitutional. either the constitution and civil liberties are for all or none. they know no one has the backbone to oppose any law that involves sex offenders so they just keep going with them. keep it up and pretty soon the death camps will be a reality. thats where their headed anyway. there is already government sanctioned hit list for would be vigilanties.
